Welcome to the Studio3 Creative Content Inc. (“Studio3”, "we”, "us", "our") website. This website, together with our directly-affiliated or subsidiary websites, is collectively referred to as the “Website”. The Website allows, among other things, for Website users to order and receive certain products and services more particularly described in relevant service agreements and/or terms of service, specific to same (the “Services”). For the purposes of this Privacy Policy, all users of the Website are “Users”, irrespective of their level of access to the Website, Services and/or any materials contained therein.

Specific Services are described in greater detail on the Website, and in the service agreement(s) and/or terms of service relevant to such Services (collectively, the “Terms”).

This Privacy Policy and our practices regarding the collection, use, disclosure and/or retention of personally identifiable information (“PII”) have been designed to comply with the Province of British Columbia’s Personal Information Privacy Act, SBC 2003, c. 63 as amended from time to time (“PIPA”) and to meet or exceed the relevant guidelines and standards published by the Office of the Information and Privacy Commissioner of British Columbia. In circumstances where PII in our custody or control flows into or out of British Columbia, the Personal Information Protection and Electronic Documents Act, SC 2000, c. 5 as amended from time to time (“PIPEDA”) may (also) apply to our collection, use, disclosure and retention of PII, and in such cases, we remain committed to upholding our obligations under that legislation as well.

This Privacy Policy is designed to be read in connection with our Terms, whether they be in the form of a discrete agreement between Studio3 and a User, or pursuant to Terms of Service available at [link / web address]. 

PURPOSE

Studio3 is committed to protecting the privacy of the Users of this Website and seeks to provide all Users with a safe and secure User experience. This Privacy Policy sets out and describes: our privacy practices; how we collect, use, disclose, retain and/or treat a User’s personally identifiable information during their use of or access to this Website and the Services; and, the part that Users themselves play in safeguarding their PII while using this Website and/or accessing the Services.

CONSENT

By accessing the Website and/or using the Services, all Users of the Website agree that they: 

(a) consent to the conditions as set out in this Privacy Policy, and 

(b) consent to the collection, use, retention, and disclosure of their personal information, if and as applicable, as set out herein. 

If a User does not agree with this Privacy Policy or, if and where applicable, our service agreement with the User, or our Terms of Service, a User’s only recourse is to immediately cease using the Website and/or Services.

WHAT IS PERSONALLY IDENTIFIABLE INFORMATION?

For the purposes of this Privacy Policy, “PII” or “personally identifiable information” means information collected which, either on its own, or in combination with other information, identifies a particular person. In the event we collect information which does not on its own directly identify a User, but such information is combined with the PII of a User, Studio3 treats any such combined information as PII.

ACCESS TO AND USE OF THE WEBSITE BY USERS

Users may use or access portions of the Website without submitting any PII. However, Users seeking to order and receive certain products and/or Services may be required to provide certain PII in order to complete those transactions. Further, to access certain Services (including, but not limited to, making bookings and registering for coaching and related services), Users will be required to create a user account with us (each, a “User Account”), and in doing so, will be required to provide us with certain PII and/or other identification information, in addition to agreeing to this Privacy Policy and the relevant Terms. Only Users with a valid, current User Account will be provided access to a secure online portal (the “Portal”) hosted on, or otherwise connected to, the Website.

COLLECTION AND USE

When you access the Website, create a User Account and/or use our Services, Studio3 may collect certain information about you, your device, your interaction with the Website and/or Portal, and information necessary to provide and improve upon our Services, analyze the effectiveness of the Website and Portal and their function and content, and to identify potential threats and vulnerabilities. Generally, PII is obtained via User-inputted entries in web-based forms on the Website, however, some PII may occasionally be collected by way of offline forms completed by individuals or Studio3 staff and provided to Studio3. Other (non-PII) information may be recorded automatically by our servers.

In order to optimize our Website, Portal, and/or Services and provide Users with a better user experience, we may collect certain User Data about Users:

  1. Personal Data: voluntarily provided information which may include your name, address, email address, billing and/or credit card information, other PII, etc.; and

  2. Log Information: non-personal anonymous demographic information, or other information automatically collected when visiting our Website.

PERSONAL DATA WE COLLECT

We only collect data that helps us achieve the purposes set out in this Privacy Policy and in the Terms relevant to Services to be provided. We will not collect any additional data beyond the data listed below without notifying a User first, and wherever required, obtain such User’s consent in advance.

We will only collect PII that a User knowingly and willingly provides to us, for example, during onboarding when creating a User Account, or when a User makes a purchase through our Website and/or the Portal.

User Account Information

When a User creates a User Account, we collect certain Personal Data, including PII, which may, but does not necessarily, include all of the following:

  • First and last name;

  • Civic address, including street address, city, province or territory, and postal code;

  • Telephone and fax numbers;

  • Email address;

  • Account password(s);

  • Company name (if applicable), and role;

  • Certain payment and billing information, including:

    • Cardholder name;

    • Credit card number (encrypted);

    • Credit card type;

    • Credit card expiration date;

    • Security Code;

    • Billing address, including street address, city, province or territory, and postal code

(“User Account Data”).

Other User-Inputted Information

From time to time, Studio3 may distribute surveys to Users and other clients, seeking data and other information respecting the Website, the Portal, its Services, and other matters relevant to Studio3’s business. These surveys may require a User to input certain Personal Data, either within the body of the survey, or as a prerequisite to accessing such survey(s).

Further, Users may opt-in to receiving certain newsletters and/or marketing materials (the “Marketing Materials”) from Studio3, which may require a User to input certain Personal Data as part of the subscription process. In every event, Studio3 shall endeavour to ensure that Users provide full and informed consent before distributing any such Marketing Materials to a User, and any such Marketing Materials shall include an “Unsubscribe” link and/or readily accessible and actionable information about unsubscribing from receipt of the Marketing Materials. Studio3 shall at all times comply with An Act to promote the efficiency and adaptability of the Canadian economy by regulating certain activities that discourage reliance on electronic means of carrying out commercial activities, and to amend the Canadian Radio-television and Telecommunications Commission Act, the Competition Act, the Personal Information Protection and Electronic Documents Act and the Telecommunications Act, SC 2010, c. 23 (“Canadian Anti-Spam Legislation” or “CASL”), as amended from time to time, and any successor legislation, generally, and in particular, respecting the Marketing Materials.

DATA COLLECTED AUTOMATICALLY

Studio3, now or in future, may, but will not necessarily, collect the following Log Information in respect of (a) User(s) when accessing the Website and/or Portal: a User’s Internet Protocol address (“IP Address”); browser type; operating system of the device used to access the Website and/or Portal; referring URLs; number of clicks; site usage, including how (and for how long) Users interact with pages or links on the Website; domain names associated with a User’s internet service provider; referral sources; pages viewed; and, similar information. 

HOW WE USE PERSONAL DATA

Data collected via our Website or the Portal will only be used for the purposes specified in this Privacy Policy and/or indicated on the relevant pages of our Website. Studio3 will not use a User’s Personal Data beyond what we disclose in this Privacy Policy.

User Account Information

When a User creates a User Account, we retain certain Personal Data and login information from such User to: verify their identity as they use the Portal; allow the User to access certain User Account Data in their User Account (and to update same, if and as required); access records of bookings made by such User; and, to access a history of purchases made while logged in to their User Account. Limited Personal Data provided in respect of User Accounts is used by Studio3 to maintain a publicly searchable database of active members. While all Personal Data of Users is stringently protected in accordance with this Privacy Policy, a User’s payment information is kept specially encrypted at all times, and only a very limited persons authorized by Studio3 may access such Personal Data in any event.

WHO WE SHARE PERSONAL DATA WITH

Studio3 will not disclose PII about you except as set forth in this Privacy Policy and/or without your consent. This section describes third parties with whom Studio3 may, but not necessarily will, disclose certain PII, and for what purposes.

We utilize the third-party payment processor, STRIPE (Canada), to collect payments for our Products and Services. For more information about how Stripe (Canada) handles end-user and other customer data, please see Stripe (Canada)’s Privacy Policy respecting Stripe (Canada)’s collection, use, and disclosure of personally identifiable information in the course of providing services to its Business Users at https://stripe.com/en-ca/privacy. By making purchases via the Studio3 Website or Portal, you agree to be bound by the Stripe (Canada)’s Privacy Policy and relevant ancillary policies.

Studio3 may, from time to time, make use of third party contractors or subcontractors to perform certain functions, including but not limited to: direct provision of services to Users; provision of all or part of a work product for a User; and, to provide tools required by Studio3 for the provision of our Services to Users. In all such cases, only as much PII as is required to perform the Services shall be provided to such third parties, and no more. Studio3 undertakes all commercially reasonable efforts to ensure that any such third parties employ privacy standards as or more robust than our own with respect to the collection, use, disclosure and retention of personally identifiable information.

OTHER DISCLOSURES

Studio3 uses this Website and/or the Portal to collect, and may use and disclose, a User’s Personal Data, including PII, in order to deliver our Services only, and will only keep such Personal Data only for as long as legitimately necessary to deliver those Services. STUDIO3 WILL NOT SELL PERSONAL DATA ABOUT USERS TO THIRD PARTIES.

We will not otherwise disclose your Personal Data unless we have your express consent or are required or permitted by law to do so. PIPA and PIPEDA permit or may require our disclosure of a User’s Personal Data without express consent where, for example, such disclosure is clearly in a User’s personal interest and their consent cannot be obtained in a timely way. Studio3 may also be permitted or required to disclose your Personal Data without your expressed consent in other exceptional circumstances, such as when required by law or legal process (such as a court order or subpoena), or to address actual or threatened illegal or harmful conduct. In general, Studio3 will limit the amounts and types of Personal Data that we collect from you to that which is necessary for providing our Services.

LINKS TO OTHER WEBSITES

The Website, the Portal, and/or Products or Services offered through same may contain links to other websites that are controlled by third parties. Studio3 is not responsible for any of the content, user terms, or privacy policies for websites that we do not own or control. Users are strongly advised to read the terms and policies of all websites they visit or mobile apps they use.

OUR RECORD RETENTION AND DESTRUCTION PRACTICES

Studio3 retains Personal Data for as long as is required for us to deliver our products and Services, maintain our database of active members, and maintain transaction and financial records as required by applicable law. Any retention of Personal Data by Studio3 is done in accordance with our obligations under PIPA and/or PIPEDA and any other legislation or regulation applicable to us with respect to the handling of Personal Data. Studio3 has appropriate procedures in place with respect to the secure destruction, deletion, and disposition of a User Personal Data when we are no longer legally obliged to retain it, including routine manual deletion of same on a day-to-day basis, as required.

Personal Data shall only be kept by Studio3 for as long as is reasonably necessary to fulfill the purposes for which such Personal Data was collected, or as required by applicable laws or regulations.

Studio3 may be permitted to retain Personal Data for a longer period whenever a User has given consent to such processing, so long as such consent is not withdrawn. Furthermore, there may be circumstances in which Studio3 may be obliged to retain Personal Data for a longer period whenever required to do so for the performance of a legal obligation or upon order of a court, tribunal, government or other such authority.

Once the reasonable retention period expires, Personal Data shall be destroyed. Therefore, any of your rights to access, rights to erasure, rights to rectification and/or rights to data portability, if any, cannot be enforced after expiration of the retention period as we will no longer possess such data.

HOW WE PROTECT YOUR PERSONAL DATA

Security of the Personal Data of Users, and any PII therein, is of the utmost importance. When a User submits sensitive information through the Website or Portal, that information is rigorously protected. 

Studio3 has imposed stringent safeguards to protect the Personal Data of Users, including PII, in our custody or control, or accessible to a User via the Website and/or through the Portal. We use the strongest available browser encryption, and security measures have been integrated into the design, implementation, and operation of the Website and the Portal. We, directly, or by way of our Third Party Providers, use a combination of firewall barriers, encryption techniques (https) and authentication procedures, among others, to protect User Accounts and systems from unauthorized access. Certain Personal Data collected in relation to payment transactions is encrypted using SSL technology. We utilize up-to-date anti-malware software as well as audit trails to record User access. Our cloud services are secure and the computers and servers in which we store Personal Data are kept in a secure environment, in secure facilities. The Personal Data of Users may be stored in servers located outside of Canada, and as such, may be accessible to courts, law enforcement, and national security authorities of those jurisdictions. In any event, whether Personal Data is stored in Canada or another jurisdiction, a comparable level of protection of such Personal Data is to be employed at all times.

Our employees with access to Personal Data are required at all times to maintain the confidentiality of the Personal Data of Users and may not use such Personal Data for any unauthorized purposes whatsoever. Our Website Admin staff will only log into the Website and/or any databases in which Personal Data is stored through a secure 2-step authenticated network. Only employees, contractors or Third Party Providers who require access to sensitive information to perform a specific job (for example, certain billing functions, or confirming registrations for certain Services) may be granted access to Personal Data, and in such events, only such Personal Data as is required to perform such functions, and no more. Such employees and/or contractors are bound by strict confidentiality agreements and a breach of this Privacy Policy would result in serious discipline, up to and including the employee’s or contractor’s termination. 

This is all done to prevent any loss, misuse, unauthorized access, disclosure or modification of a User’s Personal Data in our custody or control.

While we take all reasonable precautions to ensure that user data is secure and that users are protected, there always remains the risk of harm. The Internet as a whole can be insecure at times and therefore we are unable to guarantee the security of user data beyond what is commercially reasonable in the circumstances.

PERSONAL DATA OF MINORS

We do not knowingly collect or use personal data from individuals under 16 years of age. If we learn that we have collected personal data from an individual under 16 years of age, the personal data will be deleted as soon as practicable. If an individual under 16 years of age has provided us with Personal Data their parent or guardian may contact our Privacy Officer.

HOW TO ACCESS, MODIFY, DELETE, OR CHALLENGE THE DATA COLLECTED

Studio3 believes in the right of individuals to access their information and manage their Personal Data. Users have the right, upon submitting a request to us, to be informed of the existence, use and disclosure of their Personal Data under our control, subject to certain exceptions set out in applicable law. Users should direct requests for access to their Personal Data to our Privacy Officer. We may request that you provide us with sufficient detail and information to verify your identity and enable us to adequately respond to your request. Studio3 will attempt to respond to requests promptly and, in any event, within such timelines as may be stipulated by applicable law. Studio3 may charge a User a fee to receive copies of their Personal Data kept on record, however, we will advise you of any such fees in advance. In the event we cannot provide you with access to your Personal Data, we will inform you of the reasons why, subject to any legal or regulatory restrictions.

It is important that the Personal Data Studio3 collects is accurate and complete. Having accurate information about you is critical to our provision of the Services to Users. Users may update, correct, and otherwise revise Personal Data provided to us on their own by accessing their respective User Account, or by contacting our Privacy Officer.

Despite our best efforts, errors may occur. If a User demonstrates to us that their Personal Data in our records is inaccurate or incomplete, we will revise our records accordingly and, where relevant, make reasonable efforts to advise relevant third parties to whom that information has been disclosed. Please direct all requests for revision of Personal Data to our Privacy Officer.

COOKIES

Cookies are small pieces of data stored in text files that are saved on your computer or devices when websites are loaded in a browser. They are widely used to remember you and your preferences, either for a single visit (through a temporary “session cookie”) or for multiple repeat visits (using a “persistent cookie”).

We use cookies, device identifiers, and similar technologies such as analytics tools, web beacons, and local storage to collect information about how you use the Website.  Studio3 processes the information, including PII, collected through such technologies to further our legitimate interests in operating the Website and Portal, enhance your experience through personalization, and to assist us gaining a better insight into the features of the Website, Portal, and Services that Users are most interested in.  

Some of our Third Party Providers and third parties from which we receive content use cookies or other methods to gather information regarding your use of the Website and/or Portal. Such parties may themselves use these cookies or other tracking methods for their own purposes by relating information about your use of the Website and/or Portal with any of your PII that they may collect or possess. Use of such information by a third party depends on the privacy policy of that third party. If you would like more information, please see Section 12 for our contact information.

Studio3 and our advertisers use cookies and similar technologies to collect information for advertising purposes, such as: advertisements viewed; how often they were clicked; and device location. Such information is used to provide you with content and advertising that might be of particular interest to you.  You may also request to opt-out of an advertiser’s use of cookies, however, you will continue to receive advertisements, but those advertisements will no longer be personalized for you.

Your web browser may generate cookies for the purposes of enhancing your experience using it. You can change your browser's settings to delete cookies that have already been set and to not accept new cookies; however, please note that if you delete cookies or do not accept them, that may impact your experience of other websites. HOW YOU CAN PROTECT YOUR PERSONAL INFORMATION WHEN USING THE WEBSITE

You must also do your part to protect and safeguard your Personal Data when using the Website and/or the Portal. We strongly advise that you:

  1. use only secure, adequately encrypted internet access on each and every occasion that you log in to, create and/or modify your User Account or make purchases via the Website. You should not use unsecured public networks, such as public wi-fi from a hotel or coffee shop, when creating or accessing your User Account or making purchases requiring you to input Personal Data;

  2. do not save your password for your User Account to your phone, computer or other electronic device;

  3. do not share the password to your User Account with others;

  4. notify us immediately of any unauthorized access to or use of your User Account, including your username or password, or if you believe there is a risk of unauthorized use of your User Account;

  5. when communicating with Studio3 via email, keep any Personal Data you share to a minimum (only as much as required); and

  6. ensure that you logout from your User Account at the end of each session.

In any event, Studio3 is not responsible for any breaches of your privacy rights by third parties resulting from your failure to adhere to the above guidelines.

Any complaints, disputes, or other feedback concerning our privacy practices, procedures, and this Privacy Policy can be submitted directly to our Privacy Officer. Where appropriate, we will provide a written response to you and may amend our privacy practices and procedures or this Privacy Policy in response to your or others’ concerns.

PRIVACY BREACH RESPONSE

Studio3 shall use our best efforts to ensure that unauthorized parties will not access or obtain collected Personal Data in contravention of this Privacy Policy. However, due to the potential for interception, loss, or alteration of information transmitted over the internet, we cannot and do not guarantee complete confidentiality and security of Personal Data. Users acknowledge and agree that any information they communicate to us over the internet is at their own risk.

The security of Personal Data in our custody or control is important to us. Please advise our Privacy Officer immediately on becoming aware of any incident involving the loss of, unauthorized access to, or disclosure of Personal Data that is in our custody or control.

Employees and contractors of Studio3 will immediately report any breach of privacy, or suspected breach of privacy, to Studio3's Privacy Officer on discovery of same. A breach of privacy includes: unauthorized external or internal access to our physical records or electronic records; misdirected communications, including mail, fax, and electronic communications; and, the loss or theft of physical records or electronic records stored on data storage devices resulting from a breach of Studio3’s security safeguards.

Studio3’s Privacy Officer will coordinate a review of the matter with our management team and investigate all reported privacy breaches or suspected privacy breaches. If we become aware of a privacy breach concerning the Personal Data of (a) User(s) that creates a real risk of significant harm, we will notify the affected party (or parties) in accordance with our obligations under PIPA and/or PIPEDA, as the case may be, and may, as required by law, report the breach to the OIPCBC, OPC, and/or to government institutions (or part thereof) that may reduce the risk, or to appropriate authorities, including the police.

Studio3 shall keep a record of every data breach and, on request by a governmental authority, provide access to such records to same.

AMENDMENTS TO THIS PRIVACY POLICY

Studio3 may, from time to time, and in its discretion, amend this Privacy Policy. In doing so, Studio3 will post the updated Privacy Policy to the Website, and will updated the “Last Updated” field at the top of this Privacy Policy. If any changes made to this Privacy Policy are material (i.e., involve changes to the substantive content), Studio3 will, to the extent it is able, endeavour to provide notice of such changes via email or other telecommunications media (provided a User has a User Account with us), as well as via the posting of such notice on the Website. In any event, Studio3 recommends that Users periodically review our Privacy Policy to ensure that they are notified of any updates.
